Terms of Service

1. CONTRACT

1.1. envirobuy.com (a trading name of BARTCO (UK) Limited – Co Reg No 0871498 whose registered office is at 91-97 Saltergate, Chesterfield, Derbyshire, S40 1LA)  (‘the Supplier’) supplies its Goods and Services to its customer/s (‘the Customer’) subject to the following terms and conditions.

1.2. The terms of the contract applying to all transactions on the envirobuy website are exclusively contained in these Terms and Conditions as they may be amended from time to time and are in force at the time that the contract is entered into between the parties.

1.3. By using this website the Customer warrants that if it is a person it is over the age of 18 years and has full legal capacity to be bound by these Terms and Conditions and where it has some other legal capacity that the order hereby placed is with the full authority of that body or organisation.

2. DELIVERY

2.1. Delivery can only be made to UK mainland

2.2. Deliveries to destinations other than UK mainland can only be by prior arrangement with the Supplier and at additional cost. Such deliveries will need to be arranged through the Mail Order department during normal business hours at [email protected]

2.3. Delivery dates and times notified by the Supplier are estimates only. Unless expressly agreed by the Supplier in writing time for delivery is not and shall not be deemed to be of the essence of the contract.

2.4. The Customer shall make all arrangements necessary to take delivery of goods whenever they are notified for delivery and will only be delivered to persons aged over 18 from whom proof of age will be required in the case of age-restricted goods.

2.5. In the case of multiple orders the Supplier reserves the right to make delivery by instalments. The Supplier’s failure to deliver one or more instalments or any defect claim by the Customer in respect of any one or more instalments shall not constitute a breach of contract entitling the Customer to reject the entire order(s).

2.6. Deliveries to destinations in UK mainland are estimated to take 3-5 working days.

3. TITLE & GOODS

3.1   Title to goods will only pass on payment in full

3.2. Goods are offered for sale subject to their availability. If there is insufficient stock to meet your order we will contact you to offer an alternative product or refund the price paid for such goods as soon as possible.

3.3. The Supplier reserves the right to change details and/or product specifications without notice where this does not materially product functionality

4. PRICE

4.1. The price payable for the goods ordered is the price shown on the website at the time the Supplier receives the Customer’s order plus any applicable charges for carriage and insurance except in circumstances where an incorrect price is displayed on our website due to Supplier error. If the Supplier discovers that such an error has been made in the indicated price, the Customer will be contacted to confirm this and the Customer will then be given the option of cancelling the order or re-confirming it at the correct price. If the Supplier is unable to make contact with the Customer the order will be cancelled and any monies paid refunded

4.2. Subject to clause 3.1 the Supplier must receive payment in full for the whole of the goods ordered together with any applicable carriage and insurance charge before the order can be accepted.

4.3. The VAT inclusive prices quoted on the website are shown at the current applicable rate of VAT.

4.4. The Supplier reserves the right to alter prices at any time without prior notice and Prices and promotional offers shown on the web site may not necessarily therefore be the same as those shown in the Suppliers advertising literature elsewhere

4.5. Prices shown as reductions relate to the previous price at which the products have been made available for at least 28 days.

5. TERMS OF PAYMENT AND DEPOSITS

5.1. Customers using this website must be aged 18 years or over and proof of age will be required for the sale of specific products as the law requires or at the Supplier’s discretion.

5.2. envirobuy accepts payment only by credit card (MasterCard/Visa) or Debit cards (Maestro/ V-Pay) or Paypal

5.3. By placing an order through the web- site the Customer authorises the Supplier to debit their credit or debit card for the total amount of the order prior to the despatch of the goods to the Customer unless other credit terms have been by the Supplier in writing.

5.4. Interest at the higher of Bank of England base rate plus 4% and that payable under S69 County Courts Act 1964 shall be charged on any sum overdue for payment until paid in full

6. INSPECTION of GOODS

6.1. The Customer shall inspect the condition of the goods at the place and time of receipt.

6.2. The Customer must advise the Supplier by email or other written notification within 14 days of receipt of any claim of defect or damage.

6.3.  The liability of the Supplier shall be limited to the value of the goods purchased. The Supplier shall not be liable for any indirect or consequential loss or damage including without limitation loss of profit, of use, or of contracts arising out of the supply or failure of supply of goods ,other than liability for death and personal injury, resulting from the negligence of the Supplier and whether arising in contract, tort or otherwise.

6.4. If the Customer does not give notice within 14 days the goods will be deemed to have been delivered in the quantities shown in the delivery documents and the Customer shall not be entitled to reject the goods or claim any damages whatsoever for short delivery howsoever caused

6.5. The Suppliers liability for short delivery is limited to making good the shortage.


7. RETURNS AND CANCELLATION

7.1. The Customer has the right to cancel any order placed on this website within 14 days beginning with the day after the date goods are delivered, without giving reason but this does not affect your rights to return the goods if they are faulty.

7.2. On cancellation for any reason the Customer must return the goods in their original condition to the Supplier at their own cost unless the goods are being returned because they are faulty or incorrect, in which case the Supplier will pay the cost of the return. If goods are not returned the Supplier reserves the right to deduct the cost of recovering the goods from any refund due .

7.3. If the Customer cancels an order for goods delivered direct from a third party supplier, the Customer is responsible for contacting the Supplier to arrange collection. Such collections may incur a charge depending on the nature of the goods

7.4. Refunds will only be made to the credit card or debit card that was originally used to complete the transaction.

7.5. The Supplier reserves the right to make a deduction from any refund where the goods show signs of use or damage beyond what is reasonably necessary to establish the nature characteristics and functionality of them.
Faulty goods

7.6. Where the Customer is returning goods because they are faulty or incorrect this will be at the cost of the Supplier who nominate the carrier to be used or arrange collection direct.

7.7. After 30 days following delivery the Supplier may offer a repair or replacement of the goods or offer a price reduction or refund. The Supplier may request the Customer to contact the manufacturer or third party supplier direct if they have provided a helpline, repair service or Warranty with the goods.

8. WARRANTY

8.1. Except where the goods are sold to a person dealing as a Consumer within the meaning of the Unfair Contract Terms Act 1977 all warranties, conditions or other terms implied by statute or common law are excluded to the full extent permissible by law and the Customer shall be entirely responsible for satisfying itself as to the suitability and fitness of the goods for the Customer’s intended use and purpose.

8.2. The Seller shall not be liable for the goods failure to comply with any Warranty where the Customer has hired goods to any third parties or used or permitted their use in any manner or for any purpose for which they were not designed or intended

9. RISK

9.1. The risk in goods sold to the Customer passes when the goods are delivered.

10. DISPOSAL OF ELECTRICAL AND ELECTRONIC EQUIPMENT
The Customer is responsible for disposing/recycling  of waste or scrap electrical and electronic equipment to which the WEEE Regulations apply in accordance with those Regulations and with which the Supplier will provide assistance where legally required to so in respect of goods sold to the Customer or where they replace items of a similar nature owned by the Customer.

11. GENERAL

11.1. This agreement is subject to English Law under the exclusive jurisdiction of the English and Welsh Courts.

11.2. If any part of these Conditions is deemed by any Court to be invalid, illegal or unenforceable the validity, legality or enforceability of the other clauses and sub-clauses of these Terms shall not be affected and they shall remain in full force and effect.

11.3. All website content (design, images and text) is the copyright of Bartco (uk) Limited and its suppliers. The content may not be copied or removed, nor may the site be altered or republished in any manner.
